Introduction

GDEASIR is the specialized structure within the Ministry of Internal Affairs’ headquarters, hereinafter referred to as MIA, without legal personality that manages the general coordination of MIA activities in the field of European affairs, of Schengen-related issues and of international relations as well as the enforcement of the relevant legislation.

GDEASIR acts as national contact point for all Schengen assessment mechanism implementation-related aspects, in its relationship with the national authorities responsible with the implementation of the Schengen acquis as well as with the internal border controls waving process, while being, at the European level, the contact point in relation with the institutions and bodies of the European Union and with other member states.

Responsibilities

GDEASIR has the following main responsibilities:

  • drafts the MIA specific policies and objectives in the field of European affairs and international relations of units, institutions and structures subordinated to the MIA, in accordance with the Government Plan and the responsibilities derived from the national strategies and international legal instruments to which Romania is party;
  • coordinates the relations of MIA and its subordinated structures’ with the European Union institutions and bodies, with similar EU member states institutions and those from other states, according to its responsibilities;
  • coordinates the MIA’s participation to the drafting of European policies and legislation, according to the objectives established based on the national interests and the achievement of the obligations derived from Romania’s status as an EU member state, according to its responsibilities;
  • coordinates the Romanian representation at the Justice and Home Affairs Council, hereinafter referred to as JHAC, as well as at the committees and working groups of EU Council, European Commission and other European institutions, according to the MIA’s areas of responsibility, draws up and prepares the relevant documentation, based on the draft proposals submitted by MIA specialized structures and keeps records of the implemented activities and outcomes;
  • coordinates the process of reviwing the compliance of the national legislation in force with the European acquis and drafts proposals in order to accelerate their transposition and implementation according to MIA’s responsibilities;
  • ensures the MIA’s participation in the process of notifying the European Commission on the national legislation that transposes the European acquis and informs the European Commission on the measures taken in order to enforce the European legislation, according to the MIA’s responsibilities;
  • participates in the substantiation of the Romanian stance in the pre-litigation and litigation procedures in front of the European courts and bodies, according to MIA’s responsibilities;
  • draws up, according to its responsibilities, the documents necessary for the MIA’s management to participate in special committees within the Romanian Parliament;
  • provides the documents necessary for the MIA’s management to participate in the reunions of the Coordination Committee of the National Management System for European Affairs, established according to the provisions of art.5 of the Government Ordinance No.379/2013 on the organization and functioning of the National Management System for European Affairs in order to facilitate Romania’s participation in the decision-taking process of European Union’s institutions, as well as to supplement art.2 (1) of the Government Ordinance No.8/2013 on the organization and functioning of the Ministry of Foreign Affairs;
  • coordinates the harmonisation of the institutional framework and the administrative capacity to manage and implement the EU requirements and recommendations in Schengen area;
  • monitors and assesses the degree of achievement of the commitments undertaken by the Romanian authorities and the progress related to the Schengen field;
  • plans, organizes, coordinates and participates in the Schengen evaluation visits, within the Schengen regular evaluation mechanism and acts as contact point for scheduled and unscheduled Schengen evaluation visits, as well as in the field of training the Romanian representatives assigned to Schengen evaluation teams;
  • provides the Secretariat of the Schengen National Self-assessment Commission according to Government Decision No. 882/2006 on the establishment of the Schengen National Self-assessment Commission, further amended and supplemented, and conducts, plans, organizes and coordinates, at national level, pre-evaluation missions, drafts reports, follow-up analysis and synthesis for the consideration of the National Committee and the management of the MIA;
  • provides the strategic coordination of Romania’s interests in relationship with the European internal affairs agencies;
  • coordinates and, if the case, participates in the negotiations, endorses draft treaties, conventions and other international agreements negotiated by the structures subordinated to MIA with similar structures from other states or with entities under the jurisdiction of other states;
  • coordinates the endorsement process by MIA, according to its responsibilities, of draft treaties, conventions and other international agreements drawn up by other institutions;
  • initiates activities aimed to develop relations with similar institutions or authorities of other countries according to Romania’s foreign policy guidelines by upholding and promoting the MIA interests;
  • endorses, supports and coordinates, as required, the activities carried out by other structures of MIA in the field of European Affairs and international relations in order to secure a cohesive and coherent MIA’s stance;
  • submits for the consideration of the MIA’s management the drafting, signing, approval, endorsement or cancellation of international MIA agreements with similar structures of other countries, liaising with other institutions in order to get the required endorsements;
  • provides specialized assistance in the field of European affairs and international relations to the institutions and authorities subordinated to/within MIA and Prefectures;
  • coordinates, from the technical point of view, the activities carried out by Prefectures, in the field of European affairs and international relations;
  • keeps records of the activities carried out within the framework of the cooperation relations between MIA’s structures, of the activities carried out by the structures subordinated to MIA with similar foreign bodies;
  • participates, as mandated, to the reunions of the national and international bodies where commitments and obligations are determined within the scope of MIA, and as representative of MIA to the international bodies to which Romania is party;
  • provides guidelines, coordinates, controls and monitors the activities carried out according to its field of responsibility by the specialized structures or the personnel designated for this purpose at the level of the bodies within the MIA HQ, of the institutions and structures subordinated to MIA and to their subordinated units, to the extent of the limitations and requirements in force;
  • organizes, according to its responsibilities, external representation and international cooperation activities conducted by MIA’s home affairs attachés and liaison officers;
  • takes part in the coordination, monitoring and planning, together with MIA’s specialized structures of international missions deployed abroad, under the aegis of UN, NATO, EU, OSCE or other regional and international organizations or state coalitions;
  • coordinates the activities regarding the secondment of MIA’s staff to EU institutions or bodies or of policemen to the International Organization of Criminal Police – INTERPOL;
  • organizes and conducts protocol activities at the level of MIA management;
  • performs any other duties established by law within its duties
